Terms of Use

These terms govern your use of the Tonagi app for iOS and of the community library on this website, provided by Bernardo Barreira ("we"). By installing or using the app, or by using the library, you accept these terms. If you do not agree, do not use them.

1. What Tonagi is

Tonagi is a tuning-practice app for musicians: a tuner supporting several temperaments, a tone generator, a metronome, study sequences, practice routines and progress tracking. The app runs on your device, without user accounts. This website hosts the community library, where an optional account exists solely for publishing and liking (section 8).

2. Eligibility

The app may be used by adults and by minors with the consent and supervision of a holder of parental responsibility. The app collects no personal data and has no user accounts (please refer to the Privacy Policy). Community-library accounts are intended for users aged 16 or over. Where required by applicable law, younger users may create an account only with verifiable parental consent.

3. Licence

We grant you a personal, non-exclusive, non-transferable, non-sublicensable licence to use the app on the Apple devices associated with your account, in accordance with these terms and the App Store rules. You may not copy, modify, decompile, reverse-engineer, rent or redistribute the app, except where the law expressly permits. Apple's Standard End User Licence Agreement also applies; in case of conflict, whichever is more protective of you as a consumer prevails.

5. A study aid — no guarantee of results

Tonagi is a study aid, not a substitute for musical training. We do not guarantee any specific musical results. Pitch detection depends on factors beyond our control (device microphone, ambient noise, room acoustics, instrument characteristics): the app is provided "as is" and we do not warrant that it is fit for specific professional purposes (for example, tuning instruments for third parties or measurements with legal or contractual value).

7. Intellectual property

The app, this website, their design and texts, the Tonagi symbol and wordmark, and the code are the property of Bernardo Barreira and are protected by copyright and other rights. These terms grant you no licence over the brand.

Third-party marks and logos that may appear on this website — for example, of institutions where Tonagi is used — are the property of their respective owners and are shown with authorisation; their appearance does not imply official endorsement unless expressly stated.

8. Community library

The community library on this website is where musicians share and discover study material (sequences, routines, temperaments). Browsing and downloading require no account; publishing and liking require a basic account. When you publish:

Official material published by Tonagi may be downloaded and used for personal study and teaching purposes. Unless expressly authorised, it may not be redistributed as a standalone library, republished or commercially exploited outside the normal use of the Tonagi app and website.

9. Reporting content (notice and action)

Anyone can report an item — no account needed — using the "Report this item" form on the item's own page, or by writing to [email protected]. Describe the problem and, if you wish, leave a contact for follow-up. We review reports, remove content that breaks these terms or the law, and act on rights-holders' notices in line with the EU Digital Services Act.

Where a reporting person provides contact details, we may acknowledge receipt of the report and, where appropriate, inform them of its outcome. Where we restrict or remove content, we may notify the affected user and provide the principal reasons for our decision.

10. Privacy

Data handling is described in our Privacy Policy. In short: sound is processed on your device, the app collects no personal data, optional sync/backup uses your personal iCloud account, and a community-library account holds only your email (never public), a display name, your submissions and your likes.

11. Updates and availability

We may update, change or discontinue features of the app or of the library where reasonably necessary, including for technical, security, legal or operational reasons. We will make reasonable efforts to preserve your study data, but we recommend using the app's export functions for your own backups.

12. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect or consequential damages arising from the use of, or inability to use, the app or the library. Nothing in these terms limits rights the law grants you as a consumer, including those under Portuguese and European Union law.

13. Governing law

These terms are governed by Portuguese law, and the Portuguese courts have jurisdiction — without prejudice to the mandatory consumer-protection rules of your country of residence, which continue to apply to you wherever you are. As a consumer, you retain the alternative dispute resolution rights provided by the law of your country of residence. Many matters relating to purchases are handled by Apple as the seller of record in your country.

If you are a consumer resident in Portugal, you may also submit a complaint through the Portuguese electronic complaints book (Livro de Reclamações Eletrónico) at livroreclamacoes.pt. Complaints submitted there are answered within 15 working days.

14. Changes to these terms

We may update these terms, publishing the new version on this page with a new date. Continued use after the change constitutes acceptance. However, if material changes are made, we will provide reasonable notice before they take effect.
